Terms and Conditions

Last updated: 19 October 2026

These Terms and Conditions explain how orders placed with Happiness.mt are handled. Read them with the product description, delivery or pickup information, balloon-care guidance and our Privacy Policy.

1. About us

Happiness.mt is the trading name used by Happiness.mt. “We”, “us” and “our” refer to the trader; “you” and “your” refer to the customer.

These terms apply to purchases made through this website and orders that refer to them. Mandatory consumer rights under Maltese and EU law remain unaffected.

2. Orders and contract formation

Placing an order is an offer to purchase. An automated acknowledgement confirms receipt, not necessarily acceptance. A contract is formed when we confirm acceptance, begin preparing the order, or dispatch or make it available for pickup, whichever occurs first.

You must provide accurate contact, fulfilment, event-date and personalisation information, be at least 18, and be legally able to enter into the contract. Contact us promptly if the confirmation contains an error.

Orders remain subject to material, staff and delivery availability. We may decline or cancel for a genuine availability issue, clear pricing or description error, suspected fraud, safety concern or address we cannot serve. Payments for cancelled items will be refunded to the original payment method.

3. Products and handmade variations

Arrangements are handmade. Photographs and digital previews guide the intended design. Shape, positioning, inflated size, shade, finish and printed details can vary slightly between balloons, batches and screens. Reasonable differences that do not alter the essential design are part of a handmade product.

The product page states what is included. Props and surrounding decorations are excluded unless listed. Manufacturer sizes are nominal and actual inflated dimensions can vary.

If an important material becomes unavailable, we will contact you before making a material change. You may accept an alternative or receive a refund for the affected item.

4. Prices and payment

Prices are in euro and include applicable taxes unless stated otherwise. Delivery, setup and optional charges are shown before checkout or agreed in writing. The total is displayed before the order is placed.

Payments use the methods offered at checkout. We do not receive full card details. Promotions follow their stated conditions and cannot be exchanged for cash or combined unless allowed.

5. Personalised and custom orders

You are responsible for checking names, dates, ages, spelling and capitalisation. Submitted text is treated as approved. Live previews are illustrative; line breaks, spacing and scale may be adjusted to fit safely and clearly.

Changes are possible only before preparation begins and when confirmed by us. Extra work or materials may carry an agreed charge. If we make the personalisation incorrectly compared with the accepted order, statutory remedies remain available.

When supplying a logo, image or phrase, you confirm permission to use it and that it is lawful. We may refuse content that creates a legal or safety concern.

6. Delivery and pickup

Areas, charges and pickup options appear at checkout and on our Delivery and Pickup pages. A date or time entered on a product page is a request until accepted by us.

Provide an accurate address, access details and working telephone number, and arrange for a responsible person to receive the order. Risk passes when you, the recipient or a nominated person takes physical possession.

If delivery fails because details are wrong, access is unavailable or nobody is present, we will contact you. Any redelivery, waiting or alternative pickup charge will be explained and agreed first. Traffic, weather, road closures and venue restrictions may cause delay; we will communicate material delays and provide remedies required by law.

For pickup, arrive in the confirmed window with suitable vehicle space. Balloons can obstruct visibility and should never be left in a hot vehicle.

7. Cancellation and right of withdrawal

Contact us promptly to cancel or change an order. Before preparation or procurement begins, we will normally try to accommodate the request. Once work begins, reasonable costs already incurred may be deducted where law permits and after explanation.

The statutory 14-day withdrawal right for distance contracts does not apply to goods made to your specifications or clearly personalised. It may also be excluded for goods liable to deteriorate rapidly. These exceptions commonly affect personalised balloons, custom choices and inflated arrangements made for a specific date.

Where no exception applies, a consumer may withdraw from an eligible online purchase within 14 days after possession by sending an unequivocal statement by email. Return the goods within 14 days. Unless agreed otherwise, you bear the direct return cost. Eligible payments, including the least expensive standard delivery offered, will be refunded within the statutory period; reimbursement may wait until receipt or evidence of return.

This does not affect rights for faulty, damaged, misdescribed or non-conforming goods.

8. Problems, damage and legal rights

We must supply goods that conform to the contract. Consumer purchases benefit from the legal guarantee and remedies under Maltese law, which may include bringing goods into conformity, replacement where appropriate, a proportionate price reduction or termination. These terms do not reduce mandatory rights.

Balloon condition changes quickly, so inspect the order and report visible damage, missing items or incorrect personalisation as soon as reasonably possible. Email hi@happiness.mt with the order number, description and clear photographs. Prompt evidence helps us assess the issue but does not shorten a mandatory legal period.

Normal deflation, oxidation or deterioration caused by time, heat, sunlight, wind, sharp objects, mishandling or unsuitable storage after handover is not a defect.

9. Balloon care and lifespan

Float time depends on material, size, treatment, temperature and handling. Any duration is an estimate. Latex normally loses helium faster than foil, and clear balloons may become cloudy.

Keep arrangements indoors in a cool, stable place away from sunlight, heaters, air-conditioning outlets, rough surfaces and sharp objects. Follow product instructions and our Balloon Care guide.

10. Safety

  • Uninflated and broken balloons can cause choking or suffocation. Supervise babies, children and pets and discard broken pieces immediately.
  • Natural rubber latex can cause allergic reactions. Contact us before ordering if latex avoidance is required.
  • Foil balloons conduct electricity. Keep balloons, ribbons and weights away from power lines, electrical equipment, flames and heat.
  • Never inhale helium; it can displace oxygen and cause serious injury.
  • Do not release balloons outdoors. Keep weights attached and dispose of balloons and ribbons responsibly.
  • Large arrangements can obstruct doors, walkways, driver visibility and emergency exits.

11. Events, venues and outdoor use

You are responsible for venue permission and accurate access, parking, loading, setup and removal details. Unquoted work may require a revised price.

Sun, wind, rain and temperature affect outdoor balloons, so lifespan or position cannot be guaranteed. We may change, delay or decline an unsafe installation. If severe conditions make work impracticable, we will discuss an alternative, postponement or refund due under applicable law.

12. Liability

We do not exclude liability where unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer remedies. Subject to those rights, we are responsible for foreseeable loss resulting from our breach.

We are not responsible for avoidable loss caused by inaccurate customer information, ignored care or safety instructions, undisclosed venue restrictions, misuse after handover, or events beyond reasonable control. Consumers remain protected where law places responsibility on the trader.

Business purchases may also follow a written quotation. Consumer-only rights apply when the buyer acts outside a trade, business, craft or profession.

13. Privacy and website use

We process personal information for orders, delivery, support, fraud prevention and legal obligations as explained in our Privacy Policy. Shopify and payment, delivery or communication providers may process information where necessary.

Original website text, photography, graphics and branding belong to us or are used with permission and may not be commercially reused without consent.

14. Complaints and dispute resolution

Contact hi@happiness.mt first with the order number and requested resolution. We will review the matter and respond within a reasonable time.

If unresolved, eligible consumers may contact the Malta Competition and Consumer Affairs Authority or use its voluntary Alternative Dispute Resolution process at adr.mccaa.org.mt. The former EU Online Dispute Resolution platform was discontinued in 2025 and is not a complaint channel.

15. Changes and governing law

The terms in force when an order is placed govern it. We may update terms for future orders. The updated date appears at the top.

These terms are governed by Maltese law. Malta’s courts and tribunals have jurisdiction without removing mandatory consumer protections or other jurisdiction rights that applicable law grants.

If a provision is invalid or unenforceable, the remaining provisions continue. Delay in enforcing a right is not a waiver.
